Step 2: Click "Agree" to send the Peak One Neighborhood Registration Form and proceed to Step 3.
A person or company wishing to establish their “no risk” priority on the waiting list (the “Registrant”) will complete the online registration form together with a Pay Pal on-line form. Pay Pal will collect $500 from the Registrant. Upon acceptance of your $500 payment, the Registrant will receive an email from Pay Pal confirming that the payment has cleared. Priority within each priority group (i.e, Frisco, Ten Mile Basin and Summit County at large), will be established based upon the date and time of the Pay Pal payment confirmation.
Homes will be shown on a “first come, first serve basis”. When you are shown a home or homes, you may select a home, in which case you will be given an opportunity to enter into the contract negotiations; or, you may elect to pass at that time, but continue to hold your priority on the waiting list, or you can choose to be removed from the waiting list and your deposit will be immediately refunded. At any time you can request and will receive an immediate full refund of your deposit. Requests for refund should be made to kate @ peakoneneighborhood.com. To expedite your refund, please attach or include a copy of your Pay Pal payment confirmation.
The Waiting List Registration is for the use of direct purchasers only and a Registrant’s waiting list priority is not assignable. No commissions will be paid in connection with any sales to a Registrant.
The Waiting List Registration timeline shall be as follows:
Peak One attempts to notify Registrants on a “first come, first serve basis” (“Notification”);
Within 24 hours of Notification, the Registrant must meet with a Peak One representative to review available homes and to decide whether to enter into negotiations to purchase one of the shown homes pursuant to the standard Peak One Neighborhood Contract to Buy and Sell Real Estate. If the Registrant fails to meet with the Peak One representative or does not decide to enter into negotiations within the 24 hour period, then the Registrant shall be removed from the Waiting List and their $500 deposit shall be refunded.
Within 72 hours of Notification, Registrant and Peak One must conclude negotiations and execute the Peak One Contract to Buy and Sell Real Estate. If the parties fail to reach agreement, the Registrant can choose to be removed from the Waiting List Registration and their $500 deposit shall be refunded.
Peak One will attempt to notify the Registrant at the email address and phones number provided within the Paypal registration process. Such attempt shall include one email to Registrant’s email address and one call to each of the primary and secondary phone numbers listed.
As stated above, Registrant may request return of his/her registration security deposit at any time in which event the Deposit shall be promptly returned and the party’s name removed from the waiting list. Likewise, Peak One reserves the right to return any Deposit at anytime for any reason, in which event Peak One shall have no further obligation to the Registrant. No interest shall accrue on any Deposit. Only one waiting list registration and deposit per Registrant.
As the Deposit is fully refundable upon request by either party at anytime, no consideration has been given Peak One and Peak One has no obligation whatsoever to Registrant. The Waiting List Registration, Peak One’s delivery of the Peak One Contract to Buy and Sell Real Estate and any other acts or communications by Peak One to the Registrant, shall not be construed as an offer to sell real estate and the parties shall be bound only upon mutual execution and delivery of the Peak One Contract to Buy and Sell Real Estate. Prior to execution and delivery of the Peak One Contract to Buy and Sell Real Estate, prices are subject to change without notice.
The Registrant agrees to release and indemnify Peak One and Pay Pal against any claims whatsoever arising in connection with use of this Early Registration process.
Finally, Peak One respects Registrant’s privacy. Except for information provided to Pay Pal to process the $500 deposit, Peak One will not provide any information Registrant provides Peak One through this web site to any third party without Registrant’s prior consent.
